This Agreement (“Agreement”) describes the terms and conditions for participation in the https://www.swisszy.com Affiliate Program. The terms “Affiliate,” “you,” and “your” refer to the individual or entity applying to participate in our affiliate program. “We,” “us,” and “our” refer to Swisszy.com.
You and we are independent parties. This Agreement does not create any form of partnership, joint venture, or employer-employee relationship. If you’re entering this Agreement on behalf of a company or another individual, you confirm that you have the authority to bind them.
REGISTRATION AND USE
To join the Swisszy Affiliate Program, you must:
- Be at least 18 years old
- Have a valid Tax ID or Social Security Number (or the international equivalent)
- Submit accurate and up-to-date information during the registration process
We reserve the right to reject or terminate your participation at any time without notice or explanation, particularly if we believe you’ve violated any part of this Agreement or applicable laws.
AGREEMENT DURATION AND TERMINATION
This Agreement becomes effective once your affiliate application is approved. It will remain in effect until terminated by either party. We may terminate your participation at any time, with or without notice, especially if there’s a breach of this Agreement or a legal violation.
Once terminated, you must:
- Stop all promotional activity related to Swisszy
- Remove all Swisszy-related content and links
- Forfeit any pending or future compensation
MODIFICATION
Swisszy.com reserves the right to update or modify this Agreement at any time. This includes but is not limited to changes in commission structure, payment terms, and promotional guidelines.
Continued participation in the affiliate program following such changes indicates your acceptance of the updated terms.
COMMISSION FEES
Affiliate commissions are earned based on valid and qualified actions, as defined by specific offers. This may include:
- A percentage of revenue generated through your referrals
- A fixed commission per valid subscription or tool usage initiated by your referral
Commission eligibility is determined solely by Swisszy.com. Payments are issued once the minimum payout threshold of $50.00 USD is reached. Payouts are processed monthly, on the ___ day following the close of each calendar month, or per an alternative agreed schedule.
Returned transactions, chargebacks, or suspicious activity may result in adjustment or forfeiture of commissions.
ORDER PROCESSING
Swisszy.com is fully responsible for processing all transactions from customers referred via affiliate links. Any customer who purchases through your link will be considered a Swisszy.com customer and is subject to our policies and pricing structure.
WEBSITE RESTRICTIONS
Sites not eligible for our affiliate program include those that:
- Promote adult or sexually explicit content
- Incite violence or hate
- Encourage discrimination or illegal activity
- Use malware, spyware, adware, or misleading tactics
- Collect data without consent
- Violate intellectual property rights
- Are under construction or unable to drive traffic
- Mimic news sites or contain “fake” stories
Swisszy.com has the sole right to determine your eligibility.
FRAUD
You must not engage in cookie stuffing, false claims, misleading incentives, or any form of deceptive or fraudulent behavior. Suspicion of fraud may result in immediate termination and forfeiture of all current and future commissions.
SPAM POLICY
Swisszy.com has a zero-tolerance policy toward spam. Sending unsolicited messages (UCE) to promote affiliate links will result in account termination without payment.
DATA & INTELLECTUAL PROPERTY
Affiliates are granted a limited, revocable, non-transferable license to use Swisszy-provided marketing materials. Any user data or analytics collected in the course of your affiliate activities remain the property of Swisszy.com and must be safeguarded.
Affiliates may not share, store insecurely, or disclose such data without permission. Any data breach must be reported within 2 hours.
FORCE MAJEURE
Swisszy.com is not liable for delays or losses caused by events outside our control (e.g., natural disasters, acts of war, labor strikes, internet outages).
INDEMNIFICATION
You agree to indemnify and hold Swisszy.com harmless from any third-party claims resulting from your participation, including legal fees and penalties.
DISCLAIMER
We make no guarantees regarding your income potential or performance of the affiliate platform. Swisszy.com is not responsible for any technical issues or downtime that may impact your tracking or earnings.
MISCELLANEOUS
If any clause in this Agreement is found unenforceable, the remainder will remain valid. This Agreement is governed by the laws of [Insert Your State Here], and any disputes must be resolved in [Insert Your City and State Here].
You may not transfer or assign your rights without our written consent. However, we may assign this Agreement as part of a business acquisition or merger.
FINAL ACKNOWLEDGEMENT
By submitting your affiliate application, you confirm that:
- You’ve read and agree to all terms
- You’re not relying on any verbal or external promises
